On 1 January 2020 OJEU Thresholds will change.

The Cabinet Office released the latest changes at the end of 2019, confirming that the new thresholds would apply from the start of 2020.

Procurement thresholds

Public sector procurement is currently agreed at EU level. The EU Public Contracts Directive – transposed into UK law by the UK Public Contracts Regulations and the Public Contracts Regulations (Scotland) – sets out detailed requirements for all stages of the procurement process. This includes how contract opportunities are advertised. The thresholds indicate at what value a contract for goods, works or services must be advertised throughout the EU in the Official Journal of the European Union (OJEU).

It is mandatory for public sector contracting authorities to adhere to these regulations. However, tenderers should also be aware of advertising thresholds.

EU Thresholds 2020-2021

Changes have been made to the thresholds above which contract opportunities must be advertised in the OJEU for procurements governed by the Public Contracts Regulations, the Defence & Security Public Contracts Regulations, the Utilities Contracts Regulations and Concession Contracts Regulations.

European procurement law

The EU Public Contracts Directive – transposed into UK law by the UK Public Contracts Regulations and the Public Contracts Regulations (Scotland) –  applies to all public authorities. This includes:

  • Central government departments
  • Non-Departmental Public Bodies
  • Executive Agencies
  • Wider public sector organisations

 

The new thresholds will be valid from 1 January 2020 to 31 December 2021 and are exclusive of VAT.
