3. Explanation

   Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
   lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
   Sovini Ltd ("Soviniā€) have taken the decision to award this contract direct without prior publication with justifications that; the choice of potential suppliers is heavily limited due to the niche nature of the products/services required and two previously advertised tender received no suitable responses. Over the past 12-18 months, Sovini have embarked on a major change as part of the wider group and implementation of an overall ERP system. During both tender exercises ran, the HR and Payroll modules have been included and Sovini have not been able to identify a suppliers solution that meets the current requirements.
