   VII.2.1) Description of the modifications:
    The replacement of the Cessna F406 spotter aircraft with a Beechcraft King Air 200, fitted with electro-optic/infra-red sensors and satellite communications, in support of the Aerial Dispersant Spray service. Spare capacity will be used to support MCA requirement for maritime patrols in support of maritime safety, pollution prevention and response and maritime law enforcement.

         Instead of: The spotter aircraft is required to be available for the MCA’s use at least 98% of the time but is not routinely used due

other areas when not required for dispersant spray operations. Under this contract change, the spare capacity will be
utilised to conduct planned maritime patrols.          
         Read: The MCA currently holds a contract with RVL Aviation Limited for the provision of a service for the aerial application of oil spill dispersant using a Boeing 737 400 modified for aerial dispersant application. This service requires the use of a spotter aircraft to ensure the safety of the spray aircraft and the effectiveness of the dispersant application. Both its serviceability and its performance in recent trials have highlighted the need to upgrade the Cessna F406 spotter capability in order to deliver this part of the service in an effective manner, with a faster, more modern aircraft with greater endurance and a requisite sensor and communications suite. This upgrade will be achieved via a contract change under Regulation 72 (1) (b) of the Public Contracts Regulations on the basis that the spotter function cannot be extracted from the Aerial Spray Contract to be provided by an alternative operator without a temporary cessation of the service, during which time the safety case would need to be resubmitted, the SOPs re-written and trained on and their effectiveness demonstrated to the satisfaction of the Civil Aviation Authority. Such a cessation of service would cause significant inconvenience and would be unacceptable.
Further, as the spotter aircraft is required to be available for the MCA’s use at least 98% of the time but is not routinely used due to the rare requirement for the spray services then there is significant spare capacity in the spotter plane which must be available at short notice to be used for its primary purpose but which could be utilised by the MCA in other areas when not required for dispersant spray operations. Under this contract change, the spare capacity will be utilised to conduct planned maritime patrols at six hours’ notice for 25 hours per month. This provision will remain in place until the end of the oil dispersant contract on 31 January 2022.
The oil dispersant contract funds the fixed cost of this spare capacity however additional variable costs will be incurred to allow use of the spare capacity for this alternative purpose. The pricing under the existing contract already allows for the spray plane to be available to the MCA for urgent use. By utilising part of that capacity in the manner now proposed MCA is both meeting an additional operational need and is securing overall greater value for money for the public purse.
Contracting for additional aerial reconnaissance capacity through open competition would cause significant inconvenience for the MCA and a substantial duplication of costs and RVL is the only operator who can utilise the existing spray plane capacity to provide the additional spotter plane capacity in the manner proposed.
